Welcome to flowhouse. These Terms of Service ("Terms") govern your access to and use of the flowhouse website located at flowhouserb.com, our mobile presence, and all related services offered by flowhouse ("flowhouse," "we," "us," or "our"), a luxury reformer pilates and barre studio based in Rehoboth Beach, Delaware.

By accessing our website or using our services — including creating an account, purchasing a membership or class package, booking a class, or joining our Founding Circle — you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Note: These Terms are not a substitute for the liability waiver and membership agreement you will sign at your first studio visit or upon enrolling as a member, which contains additional binding provisions specific to participation in physical activity.

1. Acceptance of Terms

By using our website or services in any way, you represent that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 16 years of age to use our services. Individuals between 16 and 18 years of age must have the consent of a parent or legal guardian, who also agrees to these Terms on their behalf. By using our services, you represent and warrant that you meet these eligibility requirements. flowhouse reserves the right to refuse service to anyone at its discretion.

3. Accounts and Booking via Mariana Tek

To purchase memberships, class packages, or book classes, you will create an account through our booking and CRM platform, Mariana Tek. When creating an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your login credentials confidential and not share them with others.
• Notify us immediately at info@flowhouserb.com if you suspect unauthorized access to your account.

You are responsible for all activity that occurs under your account. flowhouse is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

Your use of the Mariana Tek platform is also governed by Mariana Tek's own terms of service and privacy policy. flowhouse is not responsible for the independent practices of Mariana Tek.

4. Purchases, Memberships, and Refunds

Pricing for memberships, class packages, and individual classes will be displayed at the time of purchase. By completing a purchase, you authorize flowhouse (through our payment processor) to charge your designated payment method. All sales are subject to our Studio Policies, including our cancellation, refund, and membership terms, which are incorporated by reference and available at flowhouserb.com/policies.

Refunds, membership freezes, cancellations, and billing disputes are governed by the Studio Policies. flowhouse reserves the right to update pricing and service offerings at any time, with reasonable notice to existing members.

5. Intellectual Property

All content on our website — including text, graphics, logos, images, audio clips, video, and software — is the property of flowhouse or its content suppliers and is protected by applicable intellectual property laws. The flowhouse name, logo, and brand identity are trademarks of flowhouse. Nothing in these Terms grants you any right or license to use our trademarks, trade names, or brand elements without our prior written consent.

You may access and use our website for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from our website without our express written permission.

You represent and warrant that you own or have the necessary rights to any content you submit, that the content does not infringe the rights of any third party, and that you have the consent of any identifiable individuals depicted in the content. flowhouse does not claim ownership of your content, but reserves the right to remove content that violates these Terms or that we deem inappropriate at our sole discretion.

8. Disclaimers

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted, error-free service. flowhouse does not warrant that our website will always be available, secure, or free of errors, viruses, or other harmful components.

Participation in reformer pilates, barre, and other physical fitness activities involves inherent physical risk. flowhouse is not responsible for any injury, illness, or physical harm arising from participation in studio classes, and all participants are required to sign a separate liability waiver at their first visit. You should consult with a physician before beginning any new exercise program, particularly if you have existing health conditions, injuries, or are pregnant.

9. Limitation of Liability

To the fullest extent permitted by applicable law, flowhouse and its owners, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of, or inability to use, our website or services, even if flowhouse has been advised of the possibility of such damages.

In no event shall flowhouse's total liability to you for all claims arising out of or relating to these Terms or your use of our services exceed the greater of (a) the total amount you paid to flowhouse in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless flowhouse and its owners, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our website or services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit to flowhouse.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-law principles.
